Understanding and assessing systemic change plays a key role in ensuring courts are delivering equal justice to all. This three-part webinar series, “Jumpstarting Your State’s Pretrial Improvement,” takes a look at the history and legal foundations of pretrial release, along with research, challenges and opportunities associated with this method of supervision.
The series kicks off with “Pretrial Historical and Legal Foundations,” which will introduce the history of bail (pretrial release) and “no bail” (pretrial detention), along with the overarching legal principles intertwined with that history that have been integral parts of judicial education in this generation of pretrial reform. The history and legal principles are frequently seen in court opinions as well as in un-pressured attempts to make improvements to the criminal pretrial systems in the states. Topics will include historical notions of release/detain in both England and America, the rise and fall of various legal claims surrounding bail, numerous threads of outside pressure leading to change, and the articulation of various future release/detain models likely to be adopted in America.
