Uncovering myths, realities & emerging practices in mental health courts

Mental health treatment courts (MHTCs) have expanded significantly across the United States. Guidance from adult treatment court and mental health court best practices provides a foundation for MHTCs, yet practitioners increasingly report challenges applying these frameworks to individuals living with serious mental illness (SMI).

To better understand these challenges, NCSC surveyed statewide treatment court coordinators and conducted follow-up interviews with local practitioners. 

Here's what we learned: 

  • Mental health courts are expanding rapidly.
  • Many courts rely on adult treatment court standards.
  • Few states provide SMI-specific guidance.
  • Local courts are adapting standards to meet participant needs.
  • Housing and treatment shortages remain the largest barriers.

The findings reveal a growing consensus: the field is not rejecting existing standards but rather identifying areas where additional guidance is needed to address the realities of serving individuals with SMI.

Myths vs. reality

Maintain strong partnerships with housing providers, behavioral health agencies & case management organizations

Recognize progress toward stabilization even when participants remain on waiting lists
